These terms govern your use of the Stratum PPC website and its free tools at stratumppc.com (the "Site"). Stratum PPC is operated by Alfred Gabaldon. By using the Site, you agree to these terms. If you do not agree, please do not use the Site.
What the Site provides
The Site offers free, self-serve tools that read an Amazon Ads bulk file in your browser and return diagnostics such as wasted-spend rankings, n-gram breakdowns, negative-keyword suggestions, and bid recommendations. It also offers a free diagnosis call and information about paid campaign management. The free tools are informational aids meant to help you understand your own account. They are not financial, legal, or professional advice.
No guaranteed results
Amazon advertising outcomes depend on many factors outside our control, including your products, pricing, competition, and how you act on what the tools show. We do not promise any particular ACOS, TACOS, sales, ranking, or profit result from using the Site or its tools. Any figures shown in examples or case studies describe past specific accounts and are not a prediction of your results. Decisions you make about your Amazon account are your own responsibility.
Accuracy and "as is"
The tools compute results from the file you provide, so their output is only as accurate as that file and the assumptions behind each tool. We work to keep the calculations correct, but we do not warrant that results are error-free or complete. Review any suggestion, especially bid changes and negative keywords, before applying it to a live account. The Site and its tools are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Acceptable use
When using the Site, you agree not to:
- Attempt to bypass, disable, or overload the rate limits, security controls, or serverless endpoints.
- Access the tools through automated means, scraping, or bulk scripting rather than normal browser use.
- Upload content that is unlawful, or that you do not have the right to process.
- Attempt to gain unauthorized access to any part of the Site or its infrastructure.
- Reverse engineer, copy, or redistribute the tools to offer a competing service.
Your responsibility for your Amazon account
You are responsible for complying with Amazon's own policies and agreements when you act on anything the tools suggest. Nothing on the Site is endorsed by, affiliated with, or approved by Amazon. "Amazon" and related marks belong to their owners and are used here only to describe the service.
Intellectual property
The Site, including its text, tools, code, and design, is owned by Stratum PPC and protected by applicable law. You may use the tools for your own business and share links to the Site. You may not copy, republish, or resell the tools or their underlying code without written permission. The results you generate from your own data are yours to use.
Third-party services and links
The Site relies on third-party providers (for hosting, fonts, the in-browser parsing library, rate limiting, and call booking) and may link to outside pages. We are not responsible for the content, availability, or practices of third-party services. Your use of them is governed by their own terms and policies.
Paid services
Paid campaign management is a separate engagement described on the Site and confirmed at signup. Its scope, fee, and cancellation terms are those stated at the time you sign up. These Site terms do not by themselves create a management engagement, and where a signed or written management agreement exists, that agreement controls for the paid work.
Limitation of liability
To the fullest extent permitted by law, Stratum PPC and Alfred Gabaldon will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, data, or goodwill, arising from your use of the Site or its tools. Our total liability for any claim relating to the free Site or tools will not exceed one hundred US dollars. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to hold Stratum PPC harmless from claims arising out of your misuse of the Site, your violation of these terms, or your violation of any law or third-party right, including Amazon's policies.
Changes
We may update the Site and these terms over time. Material changes will be reflected on this page with a new "last updated" date. Continuing to use the Site after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of [your jurisdiction], without regard to its conflict-of-law rules. Any dispute relating to the Site will be handled in the courts located there, unless the law gives you a non-waivable right to a different forum.
